The growth of fines promised by the Government of Ukraine for the unauthorized construction of outbuildings, houses, garages and other structures has been postponed before the end of next year. This was reported by the competent authorities.
According to officials, now the size of fines for self -building ranges from 170 hryvnia to 850. The amount depends on the properties of the erected object and its area. If self -building is actively used (that is, put into operation), then the fine can be much more.
The Code, which defines administrative and offenses, prescribes liability for the use of structures and objects that are not commissioned. The fines are much higher there than for illegal construction – they start from 5100 hryvnias and reach an amount of 6800 hryvnias. By the way, such fines are used today, but only in exceptional cases.
Officials claim that today it is not difficult to legalize self -building in Ukraine. To do this, it is only necessary to send an appropriate notification to the Gosarchstroy inspectorate. However, the department at the petition may refuse. The reasons for refusal are obvious violations of the law (primarily land), the lack of an examination of the BTI and its technical report.
Both officials and citizens who want to legalize self -building, for the most part, complain to work BTI. But the officials of the State Academy of Sciences promise that these problems are temporary. The fact is that the function of this organization to register ownership of real estate survives, as they say, the last days. Next year this function will become the prerogative of state registrars.
Competent persons warn that it is better not to delay the design of self -buildings. Otherwise, in addition to fines, unconquered buildings will create serious obstacles to the transfer or execution of property rights. Moreover, this applies to the sale and inheritance of real estate. Therefore, if now you do not start the procedure for legalizing an object, then in the future the heirs will be deprived of the opportunity to inherit such real estate.
A bill was submitted to the Verkhovna Radovna Rada on the extension of the possibility of accepting into operation of the built -in residential residential buildings (the so -called self -buildings) from 1992 to 2011. However, in the Rada, he did not receive approval-only 7 votes were not enough to adopt the bill.
